Legislature has provided special class of persons called Advocates to
practice law, Chartered Accountants to work in the area of Financial
Accounts, Cost & Management Accountants to work in the area of both
Cost & Management Accounts (Ex: Application of Ratio Analysis on
Cost & Financial Accounts). There is demarcation for respective
professionals governed by professional bodies to operate ? They should
shed off
their own narrow mindedness & come out of their cocoons & think of country's interest. Each one is trying to desperately fend off others what they think is there own sacred area.
As the issue in question has been "declared" by Supreme Court in the case of Bar Council of India Vs A.K.Balaji Dt.04.07.2012, this is the law of land in India under Article 141 of Indian Constitution & binding on all throughout the territory of India.
ONLY SOLUTION for the above problem is the Ministry of Finance, Govt. of India should seriously consider the issue in question & come out with Tax Agent Service Act in the lines of Australia or Tax Practitioners Bill in the lines of Republic of South Africa, bringing all the Tax Professionals with varied qualifications under one roof, without discrimination. The above issue should be highlighted as preamble to the TAS/TP Bill while introduction to avoid writs. Tax Professionals governed by various professional bodies should invariably seek registration under TAS/TP Bill, if they want to practice tax law. Our esteemed Govt. of Karnataka sensitive enough & seriously considering the issue in question.
