Reserve Bank of India Guideline - Standardisation and Enhancement of Security Features in Cheque Forms –Migrating to CTS 2010 standards

As per the directives issued by Reserve Bank of India (RBI), for Standardisation and Enhancement of Security Features in Cheque Forms –Migrating to CTS 2010 standards, all Banks are required to issue only CTS-2010 Standard Cheques to their customers.

The CTS-2010 standard Cheque book issued to the customers will have cheque leaves printed with words 'CTS 2010' on the left side of each of the cheque leaf.

RBI vide its circular dated September 3, 2012 has now advised Banks to withdraw non-CTS 2010 standards cheques in circulation before December 31,2012.
Customers are required to surrender existing non CTS- 2010 cheque book at their branches on or before December 31,2012 and place a request of issuance of new cheque book with CTS-2010 standards.

Customers should also ensure to replace the post-dated non-CTS 2010 standard cheques issued by them, which are due after December 31, 2012 with CTS 2010 standard cheques.

to seek votes but refuse to answer questions. Yesterday CCM Rajkumar Adukia was at a CPE event
in Pune to seek votes. Suddenly a group of CAs started asking a few uncomfortable questions on the 
100cr Nagpur land scam and the stand taken by Mr Adukia on the issue. He gave evasive replies
and said " Give me your phone number.. i will call you later.." At that point the CAs lost their temper
and fired CCM Adukia with harsh words. One CA even questioned his contribution to Council in 
last 15 years. Another CA shouted at Adukia  and told him that ICAI' s image has gone to the pits. One more CA said he was ashamed to face his son when he enquired about Nagpur land scam after reading in

1. The author in this article has analyzed the provisions of the Income-tax Act and other enactments with regard to the definition of a relative and meaning of lineal descendant. He has opined that no exemption can be claimed in respect of transfer of money/property from son to his stepmother. He has also referred to among other decisions, to the decision of the Supreme Court in the case of Kirtikant D. Vadodaria v. State of Gujarat [1996] 4 SCC 479 wherein the Supreme Court referred to the meaning of the expressions "mother" and "stepmother", as found in various dictionaries and held that "there is inherent distinction between the status of a 'mother' and 'stepmother' and they are two distinct and separate entities. Both could not be assigned the same meaning.

Web Based Status Tracking Facility Launched to Check Corruption in Income Tax Refunds

Instances of alleged corruption for settlement of refund claims and complaints come to notice from time to time. Whenever any such instance or complaints comes to notice, the same is verified and if it is found to be correct, the concerned officers/officials have to face penal consequences depending on the facts and circumstances of the case.
The process of issue of refunds has been streamlined in the course of computerization and encouraging e-filing of returns for speedy processing and issue of refunds through refund banker scheme. A web based status tracking facility for refunds has also been launched. The grievance redressal mechanism has been strengthened for ensuring prompt disposal of all such complaints.

Significant success has been achieved. An e-filed return claiming refund is now on an average processed within three to four months of its filing.

This was stated by the Minister of State for Finance, Shri S.S. Palanimanickam in a written reply to a question in the Lok Sabha today.

Who can register on TRACES?

As of now, Deductors and Tax Payers can register on TRACES.

2.       

Who is a deductor?

A Deductor is a specified person who is eligible to deduct tax on particular types of payments being made by them as per the provisions of the Income Tax Act, 1961.

 

3.       

I am a deductor. Why should I register on TRACES?

TRACES enables deductors / collectors to view challan status, download NSDL Conso File, Justification Report and Form 16 / 16A, view TDS / TCS credit for a PAN as well as verify PAN of Tax Payers linked to the deductor / collector.
TRACES also provides users with a grievance redressal mechanism to resolve issues related to TDS / TCS statements. These functionalities can be accessed only if a deductor registers their TAN on TRACES.

2 tax evasion cases by Cadbury India detected: GovtThe Directorate General of Central Excise Intelligence (DGCEI) has detected two cases of tax evasion by Cadbury India, the Minister of State for Finance, S.S Palanimanickam, said in a written reply in Rajya Sabha on Thursday. The Minister said, "two cases of tax evasion by Cadbury India Ltd have been detected by DGCEI during the years 2009-10 to 2012-13, up to October 31, 2012." One case is related to evasion of Central excise and the other is concerned with evasion of service tax. He said Central excise duty evasion by the Baddi (in Himachal Pradesh) unit of Cadbury India

ITAT to Launch e-courts in Four Cities from Dec 10The Income Tax Appellate Tribunal will launch e-courts in four cities from December 10 to facilitate hearing of cases via videoconferencing. The tribunal, a quasi-judicial body, has set up webcast facilities at Delhi, Mumbai, Nagpur and Ahmedabad, a first in the history of tax judiciary in India. In a note, ITAT said the ecourts will follow the procedures that are laid out for the bench for hearing appeals in an open court. Extesion of Due date of filing of e-forms 23AC(Non-XBRL) and 23ACA (Non XBRL) upto 24-11-2012 by MCA

Due date of filing of e-forms 23AC(Non-XBRL) and 23ACA (Non XBRL) as per new schedule VI (applicable for the accounting year commencing on or after 1.4.2011 ) has been extended upto 24.11.2012 for Companies holding AGM or whose due date for holding AGM is on or after 21.09.2012.
Such companies can now file these eForms without any additional fees upto 24.11.2012 or due date of filing, which ever is later.

Decision of the Council of the Institute at its 242nd meeting regarding cut off date for condonation of cases
The Council of the Institute at its 242nd meeting held in April, 2004 had decided that there shall be a cut off date for condonation of cases for empanelment purposes as on 1st January and the cases received beyond the cut off date will not be considered for condonation. In view of this, it has been decided interalia as under:

“For the purposes of Empanelment in the C&AG Panel prepared by office of C&AG and Bank Branch Auditors’ Panel prepared by ICAI (for which Constitution Certificates as on 1st January are issued every year), no condonation of delay in submission of Form 18 beyond 31st January preceding the financial year under audit (e.g. 31st January, 2013 for empanelment for the year 2013-14) will be done by the Institute.”
