IAESB PROPOSES CLARIFIED STANDARD ON ASSESSMENT OF PROFESSIONAL COMPETENCE

(New York/April 28, 2011) – The International Accounting Education Standards Board (IAESB) today released for public exposure a proposed revision of International Education Standard (IES) 6, Assessment of Professional Competence. The revised education standard will assist IFAC member bodies and other professional accountancy organizations in understanding both the learning and development requirements for areas of assessment of professional competence, and their obligations in upholding the standards.

IES 6, originally drafted in 2004, currently prescribes the requirements for a final assessment of a candidate’s professional capabilities and competence before qualification. The revised standard addresses elements that are essential to assessing professional competence over the career of a professional accountant. Specifically, it proposes:

          · A principles-based approach, which specifies the requirements for the assessment of professional competence across the Initial Professional Development (IPD) and Continuing Professional Development (CPD) of a professional accountant;

          · Principles of individual assessment used by member bodies to assess professional competence—applied across IPD and CPD career stages—that shall be reliable, valid, equitable, transparent, and sufficient; and

          · A requirement that IFAC member bodies undertake a formal evaluation of the adequacy of competence of aspiring professional accountants prior to their admission to the profession and have a systematic process to verify whether professional accountants meet CPD requirements.

“An overall assessment of the competence of aspiring professional accountants before qualification is essential in sustaining public trust. Professional accountants must engage in development and assessment activities to maintain competence throughout their careers due to a constantly changing work environment,” explained Mark Allison, chairman of the IAESB. “The IAESB believes that the features of these proposed revisions, which demonstrate our desire to move to a more principles-based approach in standard setting, will be more useful to IFAC member bodies and other professional accountancy organizations, educational institutions, regulators, and other interested parties than the current approach.”

The IAESB has undertaken a project to redraft all eight of its IESs in accordance with its new clarity drafting conventions, as outlined in its 2010-2012 Strategy and Work Plan. This project began in December 2010 with the proposed revision of IES 7, Continuing Professional Development: A Program of Lifelong Learning and Continuing Development of Professional Competence. A proposed revision of IES 4, Professional Values, Ethics, and Attitudes was released for exposure earlier this month, and the comment period is still open. The current timetable envisages that all IESs will have been revised and redrafted, or redrafted only, by the first quarter of 2013.

          How to Comment
The IAESB invites all stakeholders to comment on its proposals. To access the exposure draft and submit a comment, visit the IAESB’s website at www.ifac.org/Education/ExposureDrafts.php. Comments on the exposure draft are requested by July 28, 2011.
          About the IAESB
The IAESB develops education standards, guidance, and information papers for use by IFAC member bodies under a shared standard-setting process involving the Public Interest Oversight Board, which oversees the activities of the IAESB, and the IAESB Consultative Advisory Group, which provides public interest input into the development of the standards and guidance. The structures and processes that support the operations of the IAESB are facilitated by IFAC.

          About IFAC
IFAC is the global organization for the accountancy profession, dedicated to serving the public interest by strengthening the profession and contributing to the development of strong international economies. It is comprised of 164 members and associates in 125 countries and jurisdictions, representing approximately 2.5 million accountants in public practice, education, government service, industry, and commerce.

CBDT Circular on Procedure for Refund of Excess TDS

          CIRCULAR NO. 2/2011 [F.NO. 385/25/2010-IT(B)], DATED 27-4-2011
The procedure for regulating refund of amount paid by the deductor in excess of the tax
deducted at source (TDS) and/or deductible is governed by Board circular No. 285, dated
          21-10-1980.
          2. Subsequent to issue of circular No. 285, new sections have been inserted under
Chapter XVII-B of the Income-tax Act, 1961. References have been received by the
Board regarding inclusion of these sections also for the purpose of issue of refund of
excess amount of the TDS deducted/deductible.
          3. In consideration of the above and in supersession of the circular No. 285, dated 21-10-
1980, the Board prescribes the following procedure for regulating refund of amount paid
in excess of tax deducted and/or deductible in respect of TDS on residents covered under
sections 192 to 194LA of the Income-tax Act, 1961. This circular will not be applicable
to TDS on non-residents falling under sections 192, 194E and 195 which are covered by
circular No. 7/2007 issued by the Board.
          4. The excess payment to be refunded would be the difference between:
          ( i ) the actual payment made by the deductor to the credit of the Central Government;
          and
( ii) the tax deductible at source.
4.1 In case such excess payment is discovered by the deductor during the financial year
concerned, the present system permits credit of the excess payment in the quarterly
statement of TDS of the next quarter during the financial year.
4.2 In case, the detection of such excess amount is made beyond the financial year
concerned, such claim can be made to the Assessing Officer (TDS) concerned. However
no claim of refund can be made after two years from the end of financial year in which
          tax was deductible at source.
          5. However, to avoid double claim of TDS by the deductor as well as by the deductee, the
following safeguards must be exercised by the Assessing Officer concerned:
5.1 The applicant deductor shall establish before the Assessing Officer that:
          ( i ) it is a case of genuine error and that the error had occurred inadvertently;
( ii) that the TDS certificate for the refund amount requested has not been issued to the
          deductee(s); and
(iii ) that the credit for the excess amount has not been claimed by the deductee(s) in the
return of income or the deductee(s) undertakes not to claim such credit.
5.2 Prior administrative approval of the Additional Commissioner or the Commissioner
(TDS) concerned shall be obtained, depending upon the quantum of refund claimed in
excess of Rupees One Lakh and Rupees Ten Lakh respectively.
5.3 After meeting any existing tax liability of the deductor, the balance amount may be
          refunded to the deductor.
          6. In view of provisions of section 200A of the Income-tax Act prescribing processing of
statement of TDS and issue of refund with effect from 1-4-2010, this circular will be
applicable for claim of refunds for the period upto 31-3-2010.

          Change of Meerut Examination center

The following email has been received by CA News from a student:

This is with the reference to the examination center that has been assigned to Radha Govind Group of Institutions, Meerut. I would like to put your keen consideration that this Center is located in a highly sensitive area of Meerut where communal riots occur very frequently and also the traffic position of this area is very worst, Very high and risky accident zone is called in Meerut. The trucks of about 16 tyres with heavy loads move from this place which cause heavy traffic jams, single road no shortcut to reach the examination centre on Hapur Road. If you need to verify I could send you the snaps of the daily traffic jams that occur in this place. Please kindly look into this matter as this is a very serious problem for Ca students to go to this far away place from the city.

I myself is a CA student and i am facing the same problem.

Please kindly look after into the matter as early as possible and please change the examination center as soon as possible as supplementary exam option must be taken if we are not able to reach the cnter on time.

List of financial transactions with mandatory PAN provision set to grow

In order to check the number of unaccounted financial transactions happening in the country the finance ministry is now planning to bring more transactions under the ambit of the already existing list of financial transactions where-in quoting of permanent account number (PAN) is compulsory.

Apart from keeping a tab on the unaccounted income, these transactions will further help the Income Tax Department strengthen its data base and help increase tax compliance. An official at the finance ministry stated that “rules are being changed with regard to PAN requirement in cash transactions to track the investment pattern of high net worth individuals”. He said the same was aimed at ‘curbing black money transactions’.

Some of the transaction that are expected to be added to list are, sale and purchase of bullion or jewellery involving cash transfer of Rs 5 lakh or more; cash payment of Rs 1 lakh or more as life insurance premium ; and also changes are expected to be brought about in the limits for cash payment for foreign travel. At present, the cap is Rs 25,000, including fare, the fee of a travel agent/tour operator and purchase of foreign currency.

TDS information set to become primary tool of taxman to curb tax evasion

According to a senior IT official , ‘the income tax department has decided to intensify its vigil on the non-payment of TDS on interest earnings and non-disclosure of such income in the tax return’. The basic idea behind this step he stated was “to shift towards non-intrusive modes for plugging revenue leakages and enhancing compliance, instead of depending more on scrutiny.”

Though TDS forms over 37 per cent of the total tax collection, it has still till date been enjoying the taxmans’ leniency, but now the department has a plan in place to vigorously focus on TDS payments. Income from several sources like salary, interest, dividend, rents and fees for professional services are subject to TDS, the IT department however to begin with will be focus sing on bank fix deposits. It is in this area they believe that ‘either TDS is not cut at all or is not reported by the assesses even if it has been deducted.’

No Service Tax On Visa Assistance–TRU issues Circular

Tax Reserach Unit of Service Tax Headquarter has issed Circular No. 137/6/ 2011– ST to say that since assistance provided by a visa facilitator, for obtaining visa, to a visa applicant or for foreign employer does not fall within the scope of supply of man power , hence service tax is not leviable within the meaning of business auxiliary service.

However, service tax is leviable on any service provided other than assistance directly to individuals for obtaining visa, falling under the description of any taxable service, as classifiable under the appropriate heading. To cite a few instances, where in addition to rendering assistance directly to individuals for obtaining visa, visa facilitators may also act as agents of recruitment or of foreign employer, in which case, service tax is leviable to the extent under the service of ‘supply of manpower’. In certain other cases, for example, a visa facilitator, may be rendering visa assistance to individuals who are employed in a business entity, but the service charge may be paid by the business entity on behalf of those individuals, to the visa facilitator, in which case, service tax is leviable under ‘business support service’.
