AADHAAR MUST FOR LPG REFILLS

Aadhaar card must for LPG refills

Consumers to be given time to comply with Ministry order

The Ministry of Petroleum and Natural Gas has brought in an amendment to its Liquefied Petroleum Gas (Regulation of Supply and Distribution) Order 2000 making the Unique Identification Number (UID) under the Aadhaar project must for availing LPG refills.

The move is aimed at removing multiple connections and those availing cylinders in third party name and to clean up the LPG consumer base, as the government was spending heavily on subsidising the domestic LPG cylinders.

With people not showing keen interest in availing the UID or Aadhaar cards, the move of the Petroleum and Natural Gas Ministry is expected to increase the enrolment for Aadhaar.

The Ministry in its circular dated October 13, 2011 has announced the amendment to the LPG Regulation of Supply and Distribution order 2011. The Ministry's decision to make Petroleum Corporations sensitise distributors on Aadhaar card for availing refills has been published in the Gazette of India vide notification dated September 26.

The order has come into effect from the date of publication of the gazette notification.

The decision to make Aadhaar UID mandatory has been done in exercise of powers conferred under Section 3 of the Essential Commodities Act of 1955 (10 of 1955).

The amended order reads as follows: No distributor of a Government Oil Company shall supply LPG cylinder to any household unless the head of such a household furnishes Aadhaar number for each member of his or her household to the distributor within three months from the date of notification of such area.

Notification of such area means an area notified for enrolment for availing Aadhaar number i.e. UID. Many major towns in Western Tamil Nadu came under Aadhaar enrolment notification in June and July of 2011.

Officials of the Oil Corporations in Western Tamil Nadu when contacted said that distributors had been asked to sensitise consumers on the need for availing the Aadhar numbers at the earliest for availing uninterrupted supply of LPG refill.

Consumers will be given reasonable time to comply with the directive.

Treatment of deposit and interest are treated in capital gains account scheme

How deposit and interest are treated in capital gains account scheme?
Share · print · T+
QUESTION: Please refer to your answer in the Tax Forum in The Hindu dated September 26, 2011, under the title "How interest from capital gains scheme is treated?" The answer requires further clarifications on some issues.

(i) Since interest on deposit in Capital Gains Account Scheme is taxable and tax deductible, I presume that it is not required to be used for acquiring or construction of another property as for the main deposit. Kindly confirm.

(ii) I would like to know whether land located in a residential area would be treated as residential property for availing more liberal concession under Sec. 54 than under Sec. 54F.

(iii) You have stated that the reader had deposited the entire sale consideration of Rs.26.48 lakh, while what was required for getting total exemption under Sec. 54 in the reader's case was investment only of capital gains of Rs.21 lakh, since what he had sold was a residential property.

What happens to the excess deposit? Will it be liable for capital gains tax on refund?

ANSWER: The inference of the reader that interest amount can be drawn without any further obligation imposed for availing exemption from capital gains is correct. This answers the first query.

As for the meaning of "residential property", the language wherever it is used in the Chapter dealing with capital gains as for example under Sec. 54 or 54F is a "residential house" which cannot include mere land even if it is in a residential area and is meant for construction of residential houses or apartments.

An apartment is recognised as a residential house. This answers the second query.

As for the excess investment in Capital Gains Account Scheme, it can be got refunded even before the expiry of the period of three years.

In fact, refund is possible, if decided not to avail the benefit of deduction under Sec. 54 or 54F, as the case may be, even earlier to three years with the authorisation from the assessing officer under Rule 9 of the Scheme. This would apply for all excess deposits. Even if it is retained for the full period, the extra deposit amount does not involve any extra liability except that the money was locked up unnecessarily under the Scheme. This answers the third query.

BEYOND THE BOTTOM LINE

Going beyond the bottom-line
K.P. SHASHIDHARAN
Share · print · T+
K.P. SHASHIDHARAN The International Federation of Accounts (IFAC) has recommended to G-20 countries to consider at its meeting scheduled in November in Cannes, France, for developing a globally-acceptable integrated reporting framework for financial and non-financial information by all sectors.

In the period of global warming and climate change, sustainability business models necessarily should go beyond the Bottom Line to embrace the Triple Bottom Line (TBL). This concept of balancing environmental protection, economic growth and social equity was first emphasised in Brundtland in his Commission Report of 1987, and later popularised by the author of `Cannibals With Forks'-fame, John Elkington, focussing on the 3 Ps — constituted by people, planet and profitability. The zeitgeist of TBL believes in corporate social responsibility (CSR), based on measuring and controlling the social and environmental impact of business process and production.

GRI AND SUSTAINABILITY TREE

EcoSTEPS developed a `Sustainable Tree' for Ecologically Sustainable Development (ESD), embedding concerns for the people, planet along with profitability, while incorporating ingredients from the UN Agenda 21, Earth Charter, Environmental Management System, Ecological Footprint, Life Cycle Analysis, Natural Capitalism, supporting availability of resources to the future generations. Roots of the tree are formed by sustainability principles and values; carrying approaches, tools and reporting frameworks are the branches; and at the top of the tree, are process, products and people. The United Nations Environment Programme Finance Initiative (UNEP FI) is a global partnership of UNEP and the financial sector, helping to identify the roles of the financial sector in integrating both the risks and opportunities for climate change. The Global Reporting Initiative (GRI) is a TBL reporting framework launched in 1997, jointly by UNEP and CERES and the third generation GRI 3.1 is currently available, while the fourth generation framework is under preparation.

Recently, GRI has released a research paper titled `Ecosystem Services' (ES) to capture the benefits derived from the ecosystems, regarding how the organisations can factor ES into their long-term business strategic decision-making. Reporting indicators capture the quantum of natural resources harvested, produced, traded and consumed, volume of water consumed, economic cost of organisation on climate-related disasters and volume of environmentally-sustainable inputs used in the business.

New standards

The Greenhouse Gas (GHG) Protocol has recently launched two new standards to enable the organisations to measure, manage and report their GHG emissions. The first one, The Corporate Value Chain Standard, helps the entities to integrate sustainability in its decision-making, and production and trading activities. The second standard, `Product Life Cycle Standard', facilitates companies in assessment of measurement of GHG emissions. In September 2011, GRI had issued `The Construction and Real Estate Sector Supplement', providing guidance for eco-friendly green construction.

While globally, International Financial Reporting Standards is being adopted as an acceptable accounting framework, it is time for moving towards an integrated uniform reporting format, for accounting for sustainable development, going beyond the bottom-line, providing a viable, 21st century business solutions for a sustainable economy.

----------------------------------------------------------

There is need for a uniform reporting format in accounting for sustainable development — balancing environment protection, economic growth and social equity.

On e-jagrati page it is appearing

The Union Cabinet today approved the proposal under 1% interest subvention on housing loan scheme liberalising the limit of housing loan upto Rs.15 lakh where cost of the house does not exceeding Rs.25 lakh from the present limit of Rs.10 lakh and Rs.20 lakh respectively, and designating National Housing Bank (NHB) as the Nodal Agency (NA) for implementing the scheme both for Scheduled Commercial Banks and Housing Finance Companies.

Government E-Payment System to be Inaugurated; will Bring Transparency; Facilitate Paperless Transaction and Reduce Overall Transaction Cost

Ministry of Finance - PIB News
Government E-Payment System to be Inaugurated; will Bring Transparency; Facilitate Paperless Transaction and Reduce Overall Transaction Cost
The Controller General of Accounts (CGA), Department of Expenditure, Ministry of Finance has developed a fully secured Government e-payment system for direct credit of dues from the Government of India into the account of beneficiaries using digitally signed electronic advice (e-advice) through the ‘Government e-Payment Gateway’ (GePG). The Union Finance Minister Shri Pranab Mukherjee will inaugurate the Government e-Payment System on Monday. Government e-Payment Gateway (GePG) is a portal which enables the successful delivery of payment services from Pay & Accounts Offices (PAOs) for online payment into beneficiaries’ accounts in a seamless manner under a secured environment. GePG serves as middleware between COMPACT (Computerized Payment and Accounts) application at Pay & Accounts Offices and the Core Banking Solution (CBS) of the agency banks/RBI to facilitate paperless transaction, reducing overall transaction cost and promoting green banking.
This system will bring transparency and expedite direct payments from central paying units relating to subsidies to the users and consumers of fertilizer, kerosene and cooking gas which is already a declared objective of the government. This will increase the adoption of other e-services due to its efficiency and ease-of-use for all Central Government Ministries and Departments for online payment transactions. The digitally signed e-advices uploaded by the PAOs on GePG portal is downloaded by the concerned banks to credit the beneficiaries’ accounts through CBS/NEFT/RTGS as applicable. The e-payment system will save time and efforts in effecting payments and will facilitate elimination of physical cheques and their manual processing. Further the constraints of manual deposit of cheque by the payees into their bank account would also be eliminated. The system will also have online reconciliation of transactions and efficient compilation of payment accounts.
Under the traditional system of government payments, paying units in central government are using cheque, cash, DD or in few ministries ECS for payments to employees and vendors. In the past few years RTGS and NET faculties provided by RBI are also being utilized for central government payments in various ministries through the banking channel.--
