KOCHI: The Ernakulam Chief Judicial Magistrate Court on Friday turned an accused chartered accountant approver in the case in which the CBI had arrested two income tax officials for demanding and taking bribe.
Following the request of the CBI, K J Tomy, CA with Tomy and Francis Accountants, Thrissur, was
turned approver by the Chief Judicial Magistrate Court.
According to the CBI, Tomy was part of the conspiracy and knew the roles played by the conspirators. He would be able to speak about the conspiracy and offence committed by the officials and it would strengthen prosecution. Tomy’s secret statement was recorded by a Judicial First Class Magistrate as part of the procedure a few months ago.
In March 2014, P Jose Kunjippalu and C J Vincent, Assistant Commissioner with Income Tax, Thrissur, were caught red-handed while demanding and accepting `10 lakh as bribe from a local businessman. The officials had issued a notice to the businessman in 2012 to submit the document of his firm as part of checking whether he had evaded income tax. A few months later, the auditor informed the complainant that the books were scrutinised by the Assistant Commissioner of Income Tax, Thrissur, who had asked him to pay `50 lakh as penalty under Income Tax Act and Rules. Jose Kunjippalu allegedly demanded `10 lakh as bribe to settle the matter and reduce the penalty to `1 lakh.
Following the complaint lodged by the businessman, CBI officials caught the accused red-handed. They were later released following the bail granted by CBI Special Court in Kochi.
