Gross Misconduct by few managing committee members of Ghaziabad Branch of CIRC of ICAI

Dear Members,
 
Sub:- Gross Misconduct by few managing committee members of Ghaziabad Branch of  CIRC of  ICAI
 
This is to inform you that on 25th February, 2012 , Managing committee meeting was  held at Ghaziabad Branch of CIRC of ICAI to elect the  new office bearers for the term 2012-13. All the managing committee members,  two ex-officio members & two observers from ICAI, Delhi   were present in the meeting .
 
During the process of electing the chairman of Ghaziabad Branch , there was a  Tie as 4  (Four) votes each were cast in favour of two candidates CA Rajeev V.D. Gupta and CA Sanjay Garg respectively . The then chairman C.A Mukesh Bansal  insisted on putting casting vote of the chairman. CA Anuj Goel , Ex-officio Member also agreed to the validity of  Casting Vote, which was strongly protested  by the other 4  managing committee members and  C.A  Mukesh  Singh Kushwah , Ex- officio member from CIRC. Both observers too gave their valued opinion regarding illegality of  the casting vote on the basis of ICAI regulations in such a situation.
 
 CA Mukesh Singh Kushwah (Ex- officio member ) also put on record the printout of the election process of CIRC but CA Mukesh Bansal & CA Anuj Goel (Ex- officio member) claimed that it was applicable for CIRC and not for branch election. It is very surprising to conclude that election process can be different for regional council & branch managing committee.
 
CA Rajeev V.D. Gupta also suggested that the meeting be adjourned for two days and a suitable clarification  be sought from ICAI, New Delhi on the issue of casting vote, however the then chairman CA Mukesh Bansal  gave no  heed to this suggestion . It is felt that the chair was very keen to finish the agenda as per the pre-determined plans and did not wish to reach to a logical conclusion.   
 
As it is evident from the above facts, the election process was not followed by the then office bearers of the branch in letter and spirit. The opinions of learned observers from ICAI were totally ignored in own vested interest. Sue motto action were taken by the then branch chairman CA. Mukesh Bansal without following any rules & regulations of the ICAI.
 
A complaint letter detailing the above has been filed with the ICAI, New Delhi and CIRC, Kanpur  and classification on sanctity of the said meeting along with issue of casting vote is asked for.
 
We undersigned members were elected by all of you and are responsible to keep you informed  about the functioning of the branch. We always strive to give our best efforts for smooth functioning of the branch but this issue could not be resolved in spite of those best efforts.
 
We suggest that an Extra Ordinary General Meeting of all the members be called to discuss the functioning of the branch office bearers in light of the above said election process and other matters , if any . We are initiating the EGM process and request you to participate in it to save the honour of the profession and brotherhood of members of Ghaziabad .
